SEMA Sues DOT for Failure to Implement Replica Car Law

The year was 2015 and it was surprisingly good news the seemingly car-unfriendly Obama Administration with Barack Obama’s signature on it passed the FAST Act allowing replica car manufacturers to sell turn-key replica and continuation cars to the American public. A great example of the type of cars we are talking about is the Superformance Corvette Grand Sport a GM-licensed replica.

Then contrary to great expectations from the new administration NHTSA continued to stall for several years prompting SEMA on November 1, 2018 to inform NHTSA it was prepared to challenge them in court.

Today is October 17, 2019 and SEMA has filed suit. Here it is in SEMA’s words, “The Specialty Equipment Market Association (SEMA) filed a petition in federal appellate court to require the government to allow replica car manufacturers to immediately begin production. Under a 2015 law—the Fixing America’s Surface Transportation Act (FAST Act)—low volume automakers may sell up to 325 replica cars each year that resemble production vehicles manufactured at least 25 years ago. The FAST Act set a deadline of December 4, 2016 for the U.S. Department of Transportation’s National Highway Traffic Safety Administration (NHTSA) to issue any necessary regulations to implement the law. The agency has yet to take any action.

This legislation was a rider on a bigger surface transportation Bill signed into law in 2015.

Then in 2016 the EPA drafted new rules that had the effect of having nullified this portion of the FAST act.

To connect the dots:

In February 2016 the EPA proposed restrictions on so called “race cars”

Then in April 2016 POTUS 44 signed the Paris climate agreement.

Then on June 1 2017 POTUS 45 withdrew from the Paris climate agreement.

Then in May 2019 the House passed a Bill requiring the USA to return to the Paris climate agreement, with a number of states and a large number of cities pledging to follow the Paris Accord anyway...

SEMA simply wants the Government to follow its own rules, but in the meantime the government simply created more “rules”
